Description of Session:
This panel consisted of role-playing, with an investigator being crossexamined and rehabilitated during a binding arbitration of an investigation. It focused on key challenges to investigators, including preparation, technique and neutrality, since they are paid by the employer and under the attorney-client, work-product privileges, and discovery requests. The fact pattern of the investigation raises other issues, such as mental disability or insubordination, as well.
