Title IX Hearing Officer
We understand the challenges of conducting a fair, thorough hearing in an emotionally-charged atmosphere. Our well-trained Hearing Officers treat all parties with respect and empathy, while ensuring decorum and professionalism are maintained.
We are keenly aware of the challenges facing educational institutions today. We have a team of trained Hearing Officers who understand and deftly navigate the unique challenges present in a Title IX Hearing. Our Hearing Officers ensure the hearings are carried out objectively and fairly to establish reasonable grounds for all findings. All undisputed evidence is fully evaluated, and credibility is assessed as necessary.
Our Title IX Hearing Officers have experience:
Questioning parties using trauma-informed techniques,
Making admissibility and relevance decisions, and
Issuing well-reasoned, thorough decisions.
All this is done with the understanding that the recipients of such decisions include college-aged students and not attorneys. All findings and conclusions are based on a “preponderance of the evidence” standard.
Our Principles
We will work collaboratively with the campus to enhance our understanding of relevant internal policies and procedures. In concert with the campus, we will conduct any pre-hearing meetings and the Hearing itself in an organized, efficient, and controlled manner. Communications will be reviewed and responded to promptly and thoroughly. Van Dermyden Makus understands the decision may be challenged in an administrative appeal or through a formal legal proceeding, such as a writ. The Firm will be prepared to participate in the process as needed.
